This website is owned and operated by the Melbourne Magic Academy. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors an educational magic and life skills program. By accessing or using the website or our services, you approve that you have read, understood, and agree to be bound by these Terms.

1. Definitions

"Service" refers to any program, event, or activity provided by Melbourne Magic Academy, including but not limited to holiday programs, term-time classes and magic workshops.

"Participant" refers to the child enrolled in the Service.

"Parent/Guardian" refers to the individual responsible for enrolling the Participant and agreeing to these terms on their behalf.

2. Participation and Supervision

I approve my child’s involvement in Melbourne Magic Academy’s Service and have read all conditions in this document.

I give permission for my child to participate in activities organised for the days they are attending.

I acknowledge that the Melbourne Magic Academy team are responsible for the supervision and care of my child for the duration of the service.
-
If the session takes place within a school, Melbourne Magic Academy is responsible for my child until supervision is handed over to the adult nominated as responsible for the child.

All material submitted to the Melbourne Magic Academy will be kept confidential.

I authorise the Magic Academy Team to apply sunscreen to my child in the event that activities are taking place outdoors.

A participant can enrol into our term time after school magic class services up to 3 weeks into the service. The participant will be given all magic material and online support resources to learn the tricks from previous lessons of the service that they missed. The full service fee is required for a late sign up to the service, no discount or refund can be applied.

3. Medical Consent

I authorise the Melbourne Magic Academy team, in the event of an accident or illness, to seek and provide all necessary medical assistance and treatment for my child to the best of their ability.

I agree to be responsible for any expenses associated with such treatment.

I acknowledge that my child will not attend the service if suffering from an infectious or communicable disease as identified by the Department of Health.

4. Media Consent

I provide permission for Melbourne Magic Academy to capture photographic or video images of my child during the service unless stated otherwise during the enrolment process.

All rights to these images, sounds, or text are the sole property of Melbourne Magic Academy, and I make no claim over them.

I permit the use of these images for school and parent reporting, the company website, news media (newspaper, TV etc), social media, or print publications unless an opt-out request is submitted in writing during enrolment.

5. Behaviour and Discipline

I understand that if my child demonstrates inappropriate/disruptive behaviour after guidance procedures have been followed, I will be notified, and my child may be suspended or removed from the Service.

Melbourne Magic Academy reserves the right to permanently exclude any Participant for repeated inappropriate/disruptive behaviour.

6. Refunds and Cancellations
-
No refunds will be provided once a program has commenced.

A refund will be provided if a booking cancellation request is received in writing at least 7 days before the program start date, less a $50 administration fee.

No refunds will be provided for cancellations with less than 7 days’ notice.

In the event Melbourne Magic Academy cancels a full Service (a term of classes - 8 total lessons, a full holiday program, or a workshop) before the commencement date, enrolment fees will be fully refunded.

I understand that there are minimum numbers required for a program to proceed. The Melbourne Magic Academy reserves the right to cancel a full service (a term of classes - 8 total lessons, a full holiday program, or a workshop) before the commencement date if there are fewer than 10 enrollments. Enrolment fees will be fully refunded.

In the event Melbourne Magic Academy cancels a single class or multiple classes (not the full service) The Melbourne Magic Academy will endeavour to work with the venue to provide a make up class at the venue for families. Where a make up class is not possible, the magic tricks that would have been taught in the missed class will be taught in the remaining classes. This ensures that all magic in our curriculum that was intended to be taught during the term is still covered.

If a program is canceled due to government-mandated closures, parents will be offered either a refund or credit for future services.

I agree to pay for all of the days my child is successfully enrolled in, regardless of whether my child actually attends. See our “missed classes policy” for absences

7. Trial Class Policy
-
We encourage students who are uncertain about their interest in a program to book a “trial class” prior to enrolling. The cost $25 (non-refundable) to attend as a trial student (this cost is deducted from the term fees if your child continues with the class).

Children that attend the first class as a trial will participate in all class actives and learn the trick of the day. However as the magic tricks taught in a single class are part of a larger set, children attending a trial class will not be able to take the magic trick home to keep (unless of course, they decide to continue with the terms magic classes).

Trial classes are only available for Term time magic class service and not our school holiday service.

The Melbourne Magic Academy must approve your attendance at a class as a “Trial”

Only one “Trial Class” per child, per calendar year is allowed

Attendance at a second class is deemed an enrolment and full fees will become due immediately

8. Missed Classes Policy
-
No discounts, refunds, or credit will be provided for missed classes/lessons/sessions of a service

We are committed to ensuring that your child doesn't miss out on the magic learning experience. In the case of a missed class, the Melbourne Magic Academy will provide the necessary magic materials and access to our online tutorial videos for your child. This will allow them to access our online Magic Video Vault, where they can learn the effects and tricks covered in the missed class through our comprehensive support materials.

We understand that some children may require additional assistance with a magic trick taught during a missed class. To cater to this, we offer the option of short private Zoom session for personalised support. If your child needs extra guidance, please don't hesitate to email us at Admin@MagicAcademy.com.au to arrange a session.

If a student enrolled in online magic classes fails to log in within 15 minutes after the scheduled start time, the session will be considered missed, and it will be subject to our missed class policy. No discounts, refunds, or credit will be provided for missed classes.

9. Late Pick Up Policy

It is expected that every child participating in a The Melbourne Magic Academy services will be picked up on time.

A late pick-up charge of $20 per 10 minutes or part thereof, per participant, applies after the Service finishing time, however Melbourne Magic academy will provide a grace period of 10 minutes immediately after the class.

If a child is picked up late more than 3 times $80 fee applies from the first 10 minutes and Magic Academy reserves the right to suspend the child.

I authorise The Magic Academy to directly charge the credit card used for program payment for any late pick-up fees if necessary.

10. Financial Information and Payment

All fees must be paid in advance by EFT or Credit Card.

Melbourne Magic Academy reserves the right to suspend a Participant’s enrolment for overdue payments.

Enrolment fees must be paid in full before the participant can attend the service or receives any magic material from The Melbourne Magic Academy.

Only one promotional code is allowed per transaction.
-
Sibling discounts cannot be applied to single-day, partial-day or multiple single day enrolments in the school holiday service. Sibling discounts can only be applied to enrolments of full service length that can be booked directly on our booking page (Full week or Half week enrolments)

Our 'bring a friend' discount can only be redeemed by each family once per program, no matter how many friends they refer. To be eligible for the bring-a-friend discount, the referring participant must be currently enrolled or have previously attended one of our programs. The referred friend should be new to The Melbourne Magic Academy’s services.

For our School Holiday Service the 'bring a friend' discount only applies to families who enrol in the full duration of the program and not for single day/s registrations or registrations under the length of the full program.

The prices we charge for our services / products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

Your credit card details will be stored by an industry leading Secure Payment Gateway. The Melbourne Magic Academy has access only to partial information of your card (e.g. last 4 digits) and retains an authorisation to make further charges. You may remove this card authorisation at any time through by emailing us at Admin@MagicAcademy.com.au

11. Trick Replacement Policy

Care of Materials: Students are responsible for the proper care of all magic materials provided during the class. We cannot replace any lost or damaged materials or tricks, or parts thereof.

Purchasing Replacement Tricks: In certain cases where we have spare stock available, students may have the option to purchase replacement tricks. To inquire about the availability of specific tricks for purchase, please contact us via email at Admin@MagicAcademy.com.au. We will gladly assist you in checking if the requested tricks are in stock, though we cannot guarantee the availability of any specific trick.

12. Legal and Intellectual Property

Liability and Damages: Except as otherwise expressly required by law, The Melbourne Magic Academy and its agents, and representatives, does not accept any liability for personal injury, property damage or loss sustained by any participant as a result of their participation at the Service due to any cause whatsoever unless caused by the proven negligence of The Melbourne Magic Academy, its Directors or employees. You agree to indemnify and hold the Melbourne Magic Academy, its agents, and representatives, harmless from any demands, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the Melbourne Magic Academy's services. This also includes damages, compensation for any personal injuries sustained during a program.The Melbourne Magic Academy cannot ultimately be held liable.

Insurance: The Melbourne Magic Academy warrants that all necessary steps have been taken to ensure that all agreed activities are covered by Public Liability Insurance, with an indemnity limit of $30million.
The Client agrees that no demands will be made of Melbourne Magic Academy to undertake actions which would not be covered by such insurance. -
Intellectual Property: The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of the Melbourne Magic Academy. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. Clients further agree that they will not assist or allow any third party to use or reproduce any of the magic tricks, effects, or other elements presented by The Melbourne Magic Academy in any Service, whether for profit or not, without obtaining prior written permission from The Melbourne Magic Academy.

The Melbourne Magic Academy reserves the right to amend these Terms and Conditions.

13. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
